No one likes to think of a marriage ending in divorce. However, a premarital agreement can protect both parties involved. While negotiating your divorce in the process of getting married can certainly be a sensitive issue, it can greatly reduce the expense and protect your assets should divorce subsequently occur.

In addition, under Colorado law a surviving spouse has substantial rights at your death, including taking up to 50% of your estate regardless of the terms of your Will. A premarital agreement can reduce or eliminate those spousal rights.

In a premarital agreement, it is essential that both parties disclose their respective assets and that they are separately represented.
